KIDNAPPING

Prosecutors routinely attempt to charge defendants with the crime of kidnapping even if their case does not specifically warrant it. That said, the penalties for this charge can be devastating.


Although the charge itself may appear self-evident, there are a number of different stories behind a kidnapping charge, which is rarely as straight forward as it may seem. This is evidenced by the fact that prosecutors will often add the charge of kidnapping into another charge (such as rape) in order to dramatically increase the prospective penalty.
